I decided to look into this TSB and emailed the people at Fram. Here is their reply. I am still waiting a reply from the people at DM.

Mr. Cope:

Thank you for the e-mail regarding Chrysler Technical Service Bulletin 09-004-01 for the 5.9L Cummins diesel engine. We
welcome the opportunity to be of service.

There has been considerable finger pointing, unsubstantiated comments, and accusations directed at aftermarket filter
manufacturers, including Fram, regarding the quality of filters used on the Cummins 5.9L diesel engine. Fram
representatives that have investigated claims involving the Cummins 5.9L diesel engine did not find any evidence to
confirm that using Fram filters will plug oil cooling nozzles and result in engine damage.

Fram has been selling the PH3976 filters for this engine application since the engine platform launch and it has
maintained an extremely reliable service record.

Late in 2000, Cummins and Daimler Chrysler brought to our attention a low incidence failure mode in their Cummins 5.9L
Turbo Diesel engine of the piston-cooling nozzle plugging, resulting in engine failure. The plugging was caused by
contaminants including metal chips, calcium carbonate, polyethylene, and styrene butadiene that are not associated with
filter manufacture, and a neoprene compound, which is used as a sealant on the tapping plate of the filter. There were
also several other engine warranty issues determined unrelated to the piston cooling nozzle plugging that were part of
the engine failure sample.

A small amount of neoprene rubber was used in the Fram filter as a sealant. Throughout our investigation with Cummins &
Daimler Chrysler on various engine failures, no conclusive evidence was found to assign due cause to the filters or
other contamination sources. However, driven to satisfy our customers, the Fram engineering team made modifications to
the design, eliminating the neoprene, and through expedited development and manufacturing released a revised filter
model number as the PH3976A.

With the design change on the PH3976A, completely removing the use of the neoprene, there is absolutely no validity in
comments that the Fram filter should not be used for this application or that it may cause engine failures associated
with plugged nozzles.

The PH3976A is the revised version of the PH3976. Fram continues to endorse and stand behind the PH3976/PH3976A filter
for the Dodge Ram trucks with the Cummins 5.9L diesel engine.

Your Chrysler dealer may be quick to point out that the Fram PH3976 or PH3976A does not appear on their Technical
Service Bulletin list of preferred filters. The Chrysler Technical Service Bulletin 09-004-01 was issued May 18, 2001.
The revision of the Fram PH3976A occurred during the month of November 2001. Therefore, the Fram filter will not appear
on the Chrysler bulletin as a filter they choose to recommend.

It should be noted that the Honeywell Consumer Products Group warranty policy protects the consumer if it is determined
that a Fram filter is responsible for damage to an engine due to defects in design or workmanship. If you believe that
a Fram filter in your possession is defective, or if you question the quality of a specific Fram filter, we encourage
you to contact our Fram Product Evaluation Team at your earliest opportunity. The Product Evaluation Team can be

THIS is all noted (in kind) in the 94 owners manual.............WHO is Chrysler SPECIFICLY referring to?

Piston cooling?..........how about OILING !!!!
